With , is my opponent able to chose a Ninja that I already have, or he must chose one that I can actually take control of?

If he can chose a Ninja that I already have, do you think you could make a clarification errata for it, if that's what Tylar wanted it to do?

Your opponent can choose any Ninja they control. If they chose a Ninja you already control, you would not gain control of it.
