how do you determine if its a mental power battle or a regular battle????

It will always be a regular battle unless some effect makes it a mental power battle.

Here are a couple of examples of cards that can make battles become mental power battles:

J-060 Cheating (from Coils)
and
N-264 Shikamaru Nara & Temari (from Battle of Destiny)

Of course, there are many other cards that can change a battle to a mental power battle, but I'll let you have the fun of discovering those yourself.
