My guess would be after he saw Itachi die you have to remember Sasuke did look up to and loved his brother before the massacre after hearing whatever Itachi whispered to him possibly could have restored his respect for his brother. so after seeing him die could've had the same effect therefore justifies him getting the MS, but even that isn't solid evidence of him obtaining MS.
