ELIGIBILITY: Open only to legal residents of the 50 United States and the District of Columbia. Entrants must be at least six (6) years old at the time of entry. Employees of Sponsor, Cartoon Network, and their advertising and promotion agencies, affiliates, and members of their immediate families or households, are not eligible to participate. Void where prohibited or restricted by law. Federal, state and local laws and regulations apply.
SWEEPSTAKES: Sweepstakes will begin at 12:00:00 a.m. PST on February 20, 2008 and end at 11:59:59 p.m. PST on April 10, 2008 ("Sweepstakes Term"). One Grand Prize winner, two Second Prize winners and 100 Third Prize winners will be randomly selected.
TO ENTER: Sweepstakes may be accessed at www.bandai.com. Clicking on the link to the Promotions page will direct you to the Sweepstakes site ("Sweepstakes Site"). At the Sweepstakes Site, you will be required to provide your first name and email address which will be collected only for purposes of fulfilling this Sweepstakes.
Alternate Method of Entry: You can also enter by mailing a sufficiently stamped postcard to BEN 10 "The Ultimate Alien Hangout" Sweepstakes, P.O. Box 6054, Cypress, CA 90630, include your name, email address, street mailing address (no P.O. Boxes) and phone number. Entries must be received by April 15, 2008.
There is no limit to the number of entries you can submit. Any attempts by an individual to access the Sweepstakes Site via a bot script, other brute force attack, or to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair practices, or the attempt to annoy, abuse or threaten any other participant or Sponsor representative will result in that person or e-mail address becoming ineligible or disqualified and Sponsor shall have the right to disqualify entrant from the participation in any and all of Sponsor's current and future promotions. The decision of Sponsor to disqualify any entrant or entry shall be final and binding in all respects. Sponsor is not responsible or liable for technical, hardware, software or telephone failures or damages of any kind, lost or unavailable network connections, technical or human error, fraud, incomplete, delayed, incorrect, garbled, corrupted, misdirected, lost, destroyed, undeliverable or stolen entries transmitted by entrants, all of which will be disqualified. Sponsor reserves the right to cancel the Sweepstakes without notice, for any reason, including without limitation, if fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity of the Sweepstakes, and to modify or extend the Sweepstakes Term, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award any Prize at random from among the eligible entries received up to the time of the termination. All entries shall become the exclusive property of the Sponsor and will not be returned or acknowledged. By entering this Sweepstakes, entrants (and the parent or legal guardian if the entrant is a minor) accept and agree to be bound by these Official Rules and the decisions of the Sponsor, which shall be final, binding and conclusive on all matters.
Prize/Odds:
Grand Prize: One (1) winner will receive a complete bedroom makeover featuring BEN 10 themed products and décor (eg. paint, shelving, display cases, bedding, toys and artwork) (ARV: US$3,000.00). Grand Prize delivery, installation and implementation will be subject to mutual scheduling availability by Grand Prize winner and Sponsor's contractors and makeover must be commenced by April 20, 2008 and completed no later than May 20, 2008.
Second Prize: Two (2) winners will each receive one (1) Ben 10 original illustration in a customized Omnitrix frame (ARV:US$200.00).
Third Prize: One hundred (100) winners will each receive a Ben 10 toy package consisting of one (1) Transforming Alien Ship and one (1) Transforming Alien Rocks (ARV: US$15.00).
Total ARV: US$4,900.00
Many will enter to win; however only up to 103 randomly selected entrants will win. Odds of winning depend on the number of valid entries received. The selected entrants will each receive one (1) notification via email and/or phone and the selected entrants (or parent or legal guardian if such entrant is a minor) will be required to execute and return an Affidavit of Eligibility/Release of Liability and Publicity Release ("Affidavit") within seven (7) days of the date of notification, otherwise, such selected entrant forfeits any right to receive the Prize and an alternate entrant may be selected at random from the remaining eligible entries received during the applicable Drawing Period, in Sponsor's sole discretion. All entrants who are notified that they have won are deemed to be potential winners until such time as Sponsor determines in its sole discretion that the entrant is eligible to win in accordance with these Official Rules. Second Prize and Third Prize winners should receive their prizes within four (4) to six (6) weeks of Sponsor's receipt of the completed Affidavit. Sponsor is not responsible for lost, late, stolen, damaged, undeliverable or misdirected shipments. Limit one (1) prize per person, immediate family, household, dwelling, street address, home computer email account, phone line or account, DSL line or account or cable line or account (or the equivalent of any of the foregoing).
Sponsor, in its sole discretion, reserves the right to substitute an item of equal or greater value. Sponsor is not responsible for the quality or utility of any prize. The cash equivalent of any portion of any prize is not permitted, except at Sponsor's sole discretion. Sponsor will report the value of the prize as required by law. All taxes are the sole responsibility of the winner (or the parent/legal guardian if the winner is a minor). All winners of the prizes will complete all tax forms if required as requested by Sponsor. No transfer or assignment of any prize is permitted. Sponsor makes no warranty with respect to any prize. All prizes will be awarded if the number of eligible entries or verified winners is equal to or greater than the number of prizes available. Prizes won by a minor will be awarded to the parent/legal guardian of such minor.
Winners (and the parent or legal guardian if the winner is a minor) acknowledge that the prizes are awarded "as is" and that any representation, guarantee or warranty, express or implied, in law or in fact, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose is expressly disclaimed.
RELEASE OF LIABILITY AND PUBLICITY: By entering, the entrants (and the parent or legal guardian if the entrant is a minor) agree to these rules and the decisions of the Sponsor, which shall be final and legally binding in all matters relating to this Sweepstakes and accept all risks and consequences of entry and participation in this Sweepstakes and agree to release and hold harmless Sponsor, Cartoon Network, their affiliates, and each of their respective officers, directors, employees, representatives, agents, successors and assigns ("Sponsor Parties") from any and all consequences, liability, claims, judgments, injuries, property damage, damages (including without limitation, direct, indirect, consequential, punitive, incidental and special damages), losses, costs and expenses (including attorneys' fees and legal costs) of any kind, under any legal theory (collectively "Claims"), arising from, resulting from, or related to this Sweepstakes, including but not limited to the entry and participation in the Sweepstakes, acceptance, possession, delivery, use or misuse of the Prize, printing errors, any claims based upon the rights of publicity and invasion of privacy, even if one or more of the Sponsor Parties were aware of the possibility of any such consequences, losses, damages, etc. Without limiting the generality of any terms contained herein, the Grand Prize winner hereby further agrees a) that the Grand Prize and all elements thereof are delivered, installed and implemented as-is and that Sponsor or any third party will not be required to modify, replace, repair, remove, uninstall or revert any item, room or residence to a previous condition; b) to assume all risk and loss in the acceptance, possession, delivery, installation or implementation of the Grand Prize; c) to forever and irrevocably release, defend, and hold harmless the Sponsor Parties from any and all Claims arising from, resulting from or in connection with the acceptance, possession, delivery, installation or implementation of the Grand Prize by Sponsor or any third parties. Entrants (and the parent or legal guardian if the entrant is a minor) acknowledge that Sponsor has not made and hereby disclaims any warranties, express or implied, in law or in fact, with respect to this Sweepstakes and any aspect thereof. As a condition of receiving any prize, the winners (or the parent/legal guardian if the winner is a minor) irrevocably and forever consent to the Sponsor's use of the winner's name, photographs, voice, biographical information, prizes, photographs of the made-over room, statements or likenesses for publicity or advertising purposes in any and all media now known or hereafter discovered, worldwide in perpetuity, without further compensation and without the right to receive notice, review or approve by the winner (or the parent or legal guardian if the winner is a minor), where permitted by law.
